How We Help
Not every plan to travel, visit family, join a partner or do business in Australia fits neatly into one obvious visa category. Lawyers for Expats Thailand reviews your circumstances first, identifies the Australian visa pathway that appears appropriate and then helps prepare the application around the genuine purpose of your plans.
How We Help
The assessment is built around your actual plans, not a template. Here is what happens from the first call through to the decision.
We start with the purpose of the proposed travel or migration, who is involved, how long you intend to stay and what you want to achieve in Australia.
We compare the proposed plans with the relevant Australian visa pathways and identify the application route that appears most appropriate.
Once the likely route is identified, we explain and organise the supporting evidence relevant to that particular application and circumstances.
Where you proceed with the service, we prepare and manage the application from submission through to the decision. The Australian Department of Home Affairs makes the final visa decision, not Lawyers for Expats Thailand.
What We Do For Our Clients
Identifying the correct route touches the purpose of your plans, the relationships involved and the evidence that follows from both. Here is the actual scope of what our team handles.
The correct visa route depends on what the person genuinely wants to do. Possible circumstances may include visiting Australia, visiting family or friends, joining a partner, travelling to marry a prospective spouse, family migration, short business travel, or another genuine Australian visa purpose.
What if my circumstances seem to fit more than one Australian visa?
We look at the genuine purpose of the application and the individual circumstances before identifying which visa pathway appears most appropriate. The aim is to prepare the application under the route that actually reflects what the applicant intends to do.
An ordinary visitor application is fundamentally different from an application intended to establish longer-term family or partner residence. A Visitor visa is a temporary visit; a Partner visa concerns a qualifying spouse or de facto relationship; a Prospective Marriage visa concerns travel to marry a prospective spouse; family migration concerns the appropriate qualifying family pathway. Identifying which of these actually fits matters before paperwork begins.
Can I enter Australia as a visitor and then use that instead of the correct migration visa?
A Visitor visa is intended for temporary visits and should not be treated as a substitute for a migration pathway that more accurately reflects the person's real plans. We assess the intended purpose before the application is prepared.
Relationship and family cases can look superficially similar but lead to different visa pathways. Relevant distinctions can involve already being married, a qualifying de facto relationship, intending to marry, a parent-child relationship, or another qualifying family circumstance. The objective is to identify the correct service route first.
What is the difference between a Partner visa and a Prospective Marriage visa?
A Partner visa pathway is for qualifying spouses or de facto partners, while the Prospective Marriage visa is a separate route for eligible applicants intending to travel to Australia to marry their prospective spouse. Which route applies depends on the couple's real circumstances.
A short Business Visitor application is not automatically the right route simply because the person is travelling for something connected with work or business. We assess the purpose of the trip, the activities in Australia, the length of stay, the Australian organisation involved, the applicant's Thai employment or business, and whether the intended activity is actually compatible with a visitor route.
Once the route appears clear, we identify what evidence is relevant to that specific application. Depending on the route this can involve identity, relationship, family evidence, sponsor evidence, employment or business evidence, financial circumstances, accommodation, travel purpose, Thai civil documents, and other supporting evidence.
The assessment leads into the actual application service. Where the client proceeds, we prepare the application, organise supporting evidence, review consistency, prepare the matter for submission, assist with identity or biometric requirements where applicable, assist with further-information requests where appropriate, and manage the application through to decision.
Who makes the final decision about which Australian visa is granted?
Lawyers for Expats Thailand helps identify and prepare the visa pathway that appears appropriate, but the final decision is made by the Australian Department of Home Affairs.
Our Commitment To You
We identify the visa pathway from the genuine purpose and circumstances rather than choosing a visa first and trying to make the situation fit it.
We make sure you understand which pathway appears relevant and what supporting evidence will be required before preparation begins.
Once the route is identified, we organise the application and evidence around that specific purpose and circumstances.
Where you proceed with the application service, we prepare and manage the application through submission and the decision.
