A Prospective Marriage application brings together the relationship, the couple's marriage plans and the sponsor's supporting evidence. Here is the actual scope of what our team handles.
Subclass 300 is for a person who intends to travel to Australia to marry their prospective spouse. The current Home Affairs framework requires the applicant to have an eligible sponsor who is an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
Do we have to be married before applying for a Prospective Marriage visa?
No. This visa is specifically for eligible couples who intend to marry after the visa holder travels to Australia. The application needs to establish the genuine relationship and the genuine intention to marry.
We help organise evidence showing the genuine relationship between the couple. Depending on circumstances this may involve how the couple met, relationship history, time spent together, travel, communication, photographs where relevant, financial or practical support where relevant, future plans, and previous relationships or marriages where necessary.
How much relationship evidence do we need?
There is no single evidence package appropriate to every couple. The supporting material should explain the genuine relationship and its history clearly, using evidence that reflects the couple's actual circumstances.
This route is not simply about being engaged — the application needs to demonstrate a genuine intention to marry the prospective spouse. Depending on circumstances, evidence may relate to marriage plans, discussions or arrangements, intended timing, intended location, communications concerning the marriage, and other genuine preparations.
Do we need to have the whole wedding booked before applying?
Not every couple will have identical arrangements. The application needs to demonstrate a genuine intention to marry, and we organise the supporting evidence around the plans and preparations that actually exist.
The Australian prospective spouse acts as the sponsor. We help organise relevant sponsor information relating to identity, Australian citizenship, permanent residence or eligible New Zealand status, the relationship, address and circumstances, sponsorship information, and other documents relevant to the application.
Relevant Thai documentation may involve identity, civil-status documents, previous marriage or divorce documents where relevant, and other relationship evidence required for the application, with appropriate translations where relevant. Health and character requirements can also form part of the process at a high level.
Our work includes preparing the application, the relationship chronology, sponsor evidence and marriage-plan evidence, checking names and dates, checking consistency, and organising Thai supporting documents, before preparing for submission. Applicants also go through biometric or identity steps where applicable, and health or character requests can arise where applicable.
