A Partner application brings together the applicant's evidence, the sponsor's evidence and a consistent relationship story. Here is the actual scope of what our team handles.
The offshore Partner visa pathway can apply to a qualifying spouse or de facto partner of an Australian citizen, Australian permanent resident or eligible New Zealand citizen. The current offshore pathway is generally the subclass 309 provisional visa followed by consideration for the subclass 100 permanent Partner visa.
Do we have to be legally married to apply for an Australian Partner visa?
Not necessarily. Australia's Partner visa framework can apply to qualifying spouses and de facto partners. The relationship and evidence requirements depend on the couple's actual circumstances, so we establish the position before preparing the application.
The application needs to demonstrate a genuine relationship. Depending on the couple's circumstances, supporting material may involve evidence relating to relationship history, time spent together, living arrangements, communication, travel together, shared finances, household arrangements, social recognition of the relationship, future plans, and marriage documentation where applicable. Home Affairs currently requires applicants to provide evidence of their relationship with their spouse or de facto partner.
Does a marriage certificate by itself prove the whole Partner visa case?
No. A marriage certificate establishes the legal marriage, but the Partner visa application also needs to address the genuine relationship and the couple's circumstances. We organise the supporting evidence around the relationship as a whole.
The Australian-based partner is not simply mentioned in the application — sponsorship forms part of the process. We help organise relevant sponsor-side information such as identity, Australian citizenship, permanent residence or eligible New Zealand status, relationship information, address and circumstances, supporting statements or evidence, and other sponsorship information required for the application. The current subclass 309 framework requires the spouse or de facto partner to sponsor the applicant.
Does my Australian partner have to be involved in the application?
Yes. The offshore Partner visa process includes sponsorship by the qualifying Australian citizen, permanent resident or eligible New Zealand citizen partner. We help bring the applicant and sponsor sides of the application together.
One of our core jobs is consistency between the applicant's account, the sponsor's account, the relationship chronology, addresses, travel history, major relationship milestones, and financial or household evidence and future plans. The aim is to present the genuine relationship accurately and coherently, not to manufacture evidence.
Relevant Thai documents may include identity documents, marriage documentation where applicable, divorce or previous relationship documents where relevant, civil-status documents, and other relationship or supporting evidence, with appropriate translations where applicable. Health and character requirements can also form part of Australian family visa processing.
Our work includes preparing the application, organising sponsor information, the relationship chronology, supporting evidence, checking consistency and Thai documentation, before preparing for submission. Applicants also go through biometric or identity requirements where applicable, and health or character requests can arise where applicable. We manage the application through to the decision and assist with further-information requests where appropriate.
Who decides whether my Australian Partner visa is approved?
The decision is made by the Australian Department of Home Affairs. Lawyers for Expats Thailand prepares and manages the application but does not control or guarantee the outcome.
