How We Help
An Australian visa refusal does not automatically mean that the same application should simply be submitted again. Lawyers for Expats Thailand reviews the refusal decision and the original application, identifies the issues raised and helps determine the appropriate next step before preparing a stronger response or new application where applicable.
How We Help
A refusal review is built around the actual decision you received, not a template. Here is what happens from the first call through to the next step.
We start with the actual refusal decision, identifying the reasons given by the Australian Department of Home Affairs and the issues that affected the application.
We compare the refusal reasons against the information, documents and evidence originally submitted to understand what happened and whether important weaknesses or inconsistencies need to be addressed.
We assess whether the circumstances point towards a new application or whether another review pathway may be available and appropriate. Not every Australian visa refusal carries the same review rights, and reapplication is not automatically the correct response.
Where a new application or other appropriate response is pursued, we organise the evidence and prepare the matter around the issues identified in the refusal. Final decisions are made by the relevant Australian authority or review body where applicable, not by Lawyers for Expats Thailand.
What We Do For Our Clients
No two refusals raise exactly the same issues. Here is the actual scope of what our team handles.
The refusal decision is the starting point. We review the reasons given for refusal, findings made by the decision-maker, evidence discussed, requirements the decision-maker considered unmet, inconsistencies or concerns identified, and information concerning possible next steps where stated. The objective is to understand the actual decision before recommending what happens next.
Does every Australian visa refusal have a right of appeal or review?
No. Review rights depend on the type of decision and the circumstances of the case. The refusal decision and applicable process must be checked before assuming that a review pathway exists.
The original application needs to be examined alongside the refusal. Review may involve application answers, supporting documents, financial evidence, relationship evidence where relevant, employment or business evidence, sponsor information where relevant, travel purpose, previous immigration history where relevant, inconsistencies, and missing evidence identified by the decision-maker. The objective is to understand why the application failed rather than simply rebuilding the same package.
In some circumstances a fresh application may be appropriate. Before doing so, we consider what caused the refusal, whether circumstances have changed, whether stronger evidence is available, whether inconsistencies can properly be explained, whether the visa route remains appropriate, and whether another procedural option needs to be considered first.
Can I simply submit the same Australian visa application again?
Submitting substantially the same application without addressing the reasons for refusal may leave the same problems unresolved. We first identify what caused the refusal and determine what needs to change before another application is prepared.
Some Australian migration decisions may have a review pathway while others may not. Where relevant, the refusal decision and circumstances need to be examined to establish whether review rights exist, what type of process may apply, whether reapplication is a separate available option, and whether specialist Australian migration or legal advice is required.
Is an Australian visa review the same as submitting a new visa application?
No. A review process examines an existing decision through the relevant Australian review mechanism where review rights exist. A new application is a separate visa application. Which approach may be appropriate depends on the refusal and individual circumstances.
Where a fresh application is appropriate, the new application should address the actual refusal issues. Depending on the visa and refusal, this may involve strengthening financial evidence, relationship evidence, employment evidence, business evidence, family evidence, sponsor evidence, purpose-of-travel evidence, Thai supporting documents, explanations of previous inconsistencies, and other evidence relevant to the refusal. Simply providing more documents does not guarantee approval.
Once the appropriate route has been established, we help organise and manage the agreed next stage. This may include, where appropriate, preparing a new application, restructuring supporting evidence, addressing previous refusal issues, preparing explanations, organising Thai documents, coordinating evidence from Australia, preparing the matter for submission, assisting with further-information requests, and managing the matter through to the next decision.
Can Lawyers for Expats guarantee that my visa will be approved after a refusal?
No. No genuine visa service can guarantee an Australian immigration decision. Lawyers for Expats Thailand prepares and manages the matter carefully, but the final decision remains with the relevant Australian authority.
Our Commitment To You
We review what the Australian decision-maker actually said before recommending what should happen next.
Where a new application is appropriate, we build it around the issues that caused the previous refusal rather than simply resubmitting the same evidence.
We help establish whether the circumstances point towards reapplication or whether another available process needs to be considered.
Where you proceed, we organise the evidence and manage the agreed next stage through to the relevant decision.
