Route assessment touches the genuine purpose, the relevant US pathways and the evidence they each require. Here is the actual scope of what our team handles.
The visa route should follow what the applicant genuinely intends to do. Possible circumstances can include tourism, visiting family or friends, temporary business activity, travelling to marry a US citizen fiancé(e), immigrating as the spouse of a US citizen, qualifying family-based immigration, and other legitimate US visa purposes.
What if my circumstances seem to fit more than one US visa?
We look at the genuine purpose of the proposed travel or immigration and the applicant's individual circumstances before identifying which route appears most appropriate. The objective is to use the visa pathway that actually reflects what the person intends to do.
Temporary visitor applications and immigrant or family applications serve fundamentally different purposes. B-1/B-2 covers temporary visitor purposes, K-1 is the fiancé(e) route for an eligible US citizen's foreign fiancé(e), CR-1/IR-1 is the immigrant spouse route, and family-based immigration covers qualifying family relationships. Route selection needs to happen before paperwork begins.
Can I use a visitor visa instead of the correct immigrant or fiancé(e) visa?
A visitor visa is intended for genuine temporary travel and should not be treated as a substitute for an immigration or fiancé(e) route that better reflects the person's real plans. We assess the intended purpose before the application is prepared.
Relationship-based cases may appear similar but have different US immigration routes. Relevant questions include whether the couple is already legally married, whether they are engaged and planning to marry in the United States, who the US petitioner is, the petitioner's US status, the exact family relationship, and whether the purpose is temporary or permanent immigration.
What is the difference between the K-1 fiancé(e) route and the CR-1/IR-1 spouse route?
The K-1 is a fiancé(e) route for an eligible foreign fiancé(e) of a US citizen who intends to marry that petitioner in the United States. The CR-1/IR-1 route is for a qualifying spouse where the couple is already legally married. Which route applies depends on the couple's actual circumstances.
A trip connected with business does not automatically mean B-1 is the correct classification. We assess the actual purpose of travel, the activities the applicant will perform, the US organisations involved, Thai employment or business circumstances, and whether the activity is temporary business visiting or something requiring another visa classification.
What if I am going to the United States for business but I am not sure whether B-1 applies?
The actual activities matter. B-1 is designed for permitted temporary business visitor activity and is not a substitute for a work visa. We review what you intend to do before identifying the route that appears appropriate.
Once the likely route is clear, we identify the relevant evidence. Depending on the route, this may involve travel purpose, relationship evidence, marriage evidence, family relationship evidence, petitioner or sponsor evidence, employment or business documents, financial evidence, civil documents, identity documents, travel history, Thai supporting documents, and other case-specific material.
Route assessment leads into the actual application service. Where the client proceeds, we help prepare application information, organise supporting documents, check names and dates, check consistency, organise evidence from the US side where relevant, prepare the Thai applicant for the relevant process, help respond to further-document requests where appropriate, and support the matter as it progresses. Where a matter involves complex US legal issues beyond our verified role, specialist US immigration or legal advice may be appropriate.
Who makes the final decision about which US visa is granted?
