How We Help
A refusal review is built around the actual decision and the applicant's circumstances, not a template response. Here is what happens from the first call through to the next application or step.
We start with the refusal letter and, where provided, the officer decision notes so we understand the reasons recorded by IRCC.
We review what was actually submitted, including the forms, supporting evidence and explanations, rather than trying to assess the refusal in isolation.
We identify weaknesses, missing evidence, inconsistencies or changed circumstances that may need to be addressed before another application is considered.
Where reapplication is appropriate, we rebuild the case around the refusal reasons and the applicant's current circumstances rather than simply submitting the same application again. IRCC makes the immigration decision, not Lawyers for Expats Thailand.
What We Do For Our Clients
A refusal review touches the decision itself, the previous application and the appropriate next step together. Here is the actual scope of what our team handles.
The review begins with the actual decision. IRCC refusal material can identify issues involving matters such as purpose of travel, financial evidence, temporary intent, study purpose, supporting documentation, admissibility, relationship or family evidence, and other application-specific concerns. Where IRCC has supplied officer decision notes, we review those as well.
Will IRCC tell me why my Canadian visa application was refused?
IRCC sends a refusal letter explaining the decision. For most temporary resident applications, IRCC now also provides the final officer's decision notes with the refusal letter. Those materials should be reviewed carefully before deciding what to do next.
A refusal cannot be assessed properly by reading only one sentence from the refusal letter. We review application forms, supporting documents, financial evidence, employment or business evidence, relationship evidence where relevant, study evidence where relevant, invitation or support evidence, written explanations, travel history where relevant, and consistency between documents.
Current IRCC guidance says an applicant can generally apply again after refusal unless the decision letter says otherwise, but IRCC specifically warns that applying again with the same information is unlikely to change the decision. Reapplication should be considered where circumstances have materially changed, new evidence exists, missing evidence can be supplied, or the previous refusal reasons can genuinely be addressed.
Can I simply submit the same Canadian visa application again?
Submitting the same application with the same information is unlikely to produce a different result. Before reapplying, the refusal reasons should be understood and the new application should contain meaningful evidence or changed information that addresses those concerns.
Where reapplication is appropriate, we help reorganise evidence around the specific refusal. Depending on the route, this might involve clearer travel purpose, stronger financial explanation, better employment or business evidence, relationship evidence, family circumstances, study purpose, sponsor or support evidence, corrected inconsistencies, updated circumstances, missing documents, and clearer written explanation.
For temporary residence refusals, there is no formal statutory appeal process. Depending on the circumstances, applicants may instead consider reapplication, a request for reconsideration, or an application for leave and judicial review in the Federal Court, but these are not interchangeable. Judicial review is not a fresh visa application and does not simply substitute our opinion for IRCC's decision. Specialist Canadian legal advice may be required where a challenge to the legality or fairness of the decision is being considered.
Can I appeal a Canadian visitor visa or study permit refusal?
There is no formal appeal process for Canadian temporary residence refusals. Depending on the circumstances, an applicant may instead consider reapplying, requesting reconsideration or seeking specialist Canadian legal advice about judicial review. The appropriate route depends on the actual decision and circumstances.
Where reapplication is appropriate, we help with refusal review, officer-note review where available, original application comparison, changed-circumstances review, evidence strategy, updated forms, updated supporting documents, written explanations, consistency checks, submission preparation, biometrics where applicable, further-document requests, and support through decision.
Who decides whether my Canadian visa will be approved after reapplication?
Immigration, Refugees and Citizenship Canada makes the decision on the new application. Lawyers for Expats Thailand can help address the previous refusal and prepare the new evidence, but representation does not guarantee approval.
