We manage the application from submission through to the decision, helping the couple understand each stage and assisting with further information requests where appropriate. The final decision is made by the UK immigration authority, not by Lawyers for Expats Thailand.
What We Do For Our Clients
A UK spouse application touches the relationship, finances, accommodation and language requirements together. Here is the actual scope of what our team handles.
The application needs to reflect the couple's actual circumstances. That can include the marriage or qualifying partnership, relationship history, how the couple met, time spent together, periods living together where relevant, previous relationships or marriages where relevant, plans to live together in the UK, and the circumstances of the UK-based partner.
Is being legally married enough to guarantee a UK spouse visa?
No. A valid marriage is important, but the application is assessed against the applicable UK family visa requirements as a whole. The relationship, financial and other relevant requirements still need to be evidenced properly.
We help organise evidence showing the history and reality of the relationship. Depending on the circumstances this may involve marriage documentation, evidence of time spent together, communications where relevant, travel evidence, photographs where relevant, shared financial or living arrangements where relevant, and evidence concerning previous marriages or relationships where necessary.
Do we need to prove our relationship even if we are already married?
Yes. The application can require evidence about the relationship itself as well as evidence of the legal marriage. We prepare the evidence around the couple's actual history and circumstances.
Financial requirements form an important part of many UK spouse and partner applications. We help identify and organise the relevant evidence depending on the income or financial circumstances being relied upon — potentially employment income, self-employment or business income, savings, pension or other qualifying income, or combinations of permitted income sources where applicable.
Does every couple meet the financial requirement in the same way?
No. The evidence depends on the financial circumstances and the income or other permitted resources being relied upon. We identify what evidence is relevant to the particular application.
The application may need to show appropriate accommodation and the couple's intended living arrangements in the UK. Our work can involve organising evidence relating to the intended UK address, ownership or tenancy arrangements where relevant, who lives at the property, and accommodation evidence appropriate to the circumstances.
The applicant may need to satisfy the applicable English-language requirement unless an exemption applies. We identify the English-language and document requirements relevant to the application and organise the supporting evidence accordingly. Where Thai-language documents require an appropriate English translation, this is identified during preparation.
Our work includes preparing the application, checking names, dates and relationship information, checking consistency between the evidence and the answers given, organising the final evidence package and preparing for submission. Applicants also go through an identity and biometric stage. We manage the application through to the decision and help respond to further-document requests where appropriate — health or document requirements such as a TB certificate can also apply depending on the applicant's circumstances and current UK rules.
Who decides whether the spouse visa is granted?
The decision is made by the relevant UK immigration authority. Lawyers for Expats Thailand prepares and manages the application but does not control or guarantee the outcome.
