Many foreigners are now in a vicarious position with their property for setting up a company with nominees to enable them to circumvent the laws regarding foreign ownership.

Foreigners cannot own land in their name nor landed property unless the land has been split from the building above .


Foreigners can register a lifetime usufruct on the land or the land and house or have a lease which is restricted to 30 years or a Superfeices that can be registered for a lifetime if the land office permits it .


Not talked about that often is the Sap In Sith which gives foreigners stronger rights than conventional leasing .


This hasn’t been popular among foreigners as the 30 year lease with two promises of renewals has been the path of least resistance used by most but this has been made void and unenforceable.


It is important to note that the Supreme Court has recently restricted promises of renewal and agreements that go beyond 30 years .

This includes leases made before this ruling came into action .


Promises of a term or collective of terms totaling more than 30 years have been made void and not enforceable in a court of law.

For people already in lease agreements with promises of 30 plus 30 year renewals it may well be worth while re addressing your current status and consider your options .

Most definitely we strongly advise against the formation of Thai Companies for the purpose of owning property with the use of nominees it is illegal and not safe.
