Deciding to Report and What to Prepare
If something has gone wrong in Thailand, your first instinct might be to deal with it yourself. Many foreigners do.
Perhaps you've been scammed. Your wallet has been stolen. Your motorbike has disappeared. Someone has assaulted you. You've been threatened. Or you've become the victim of fraud.
Whatever has happened, there comes a point where you need to decide whether to involve the police.
For some people that's an easy decision. For others, it's not. They've heard stories online. Friends tell them it's pointless. Someone in a Facebook group says the police won't be interested.
Let's start by clearing something up.
Thailand's police deal with thousands of incidents involving foreigners every year. Some cases are resolved quickly. Others take much longer. Like every country, the outcome depends on the evidence available, the seriousness of the incident and the circumstances surrounding it.
The important thing is understanding what to expect before you walk through the door of a police station.
A Practical Note
A common mistake is waiting too long before reporting something. People spend days asking strangers on social media what to do, try negotiating with the person themselves, or hope the problem will simply disappear. Sometimes it does. Often it doesn't.
The longer you wait, the harder it becomes to establish exactly what happened. Evidence disappears, messages get deleted, witnesses become harder to find and memories fade. If you have genuinely been the victim of a crime, don't assume time is on your side.
When Should You Report a Crime?
Not every disagreement is a criminal offence.
Arguments between neighbours. Contract disputes. Refund disagreements. Many of these are civil matters rather than criminal ones.
However, if you've been the victim of theft, assault, fraud, criminal damage, threats or another suspected offence, reporting it promptly is usually the sensible course of action.
Even if you're unsure whether a crime has actually been committed, the police can often advise whether the matter falls within their responsibility. Don't let uncertainty stop you from asking.
Choosing the Right Police Station
In most situations, crimes should be reported to the police station responsible for the area where the incident took place.
If you're unsure which station that is, ask your hotel, your accommodation provider or a trusted local contact.
If you're dealing with an emergency where someone is in immediate danger, your priority should always be contacting the emergency services rather than worrying about which station has jurisdiction.
For less urgent matters, attending the correct station from the outset can help avoid unnecessary delays.
Before You Leave
Take a few minutes to gather anything that may help explain what happened. That could include:
- Your passport or identification.
- Photographs.
- CCTV footage if available.
- Screenshots of conversations.
- Bank transfer records.
- Receipts.
- Booking confirmations.
- Vehicle registration details.
- Names and telephone numbers of witnesses.
Don't worry if you don't have everything. But the more organised you are, the easier it will be to explain your situation clearly.
A Practical Note
Preparation often changes the entire conversation. Someone who arrives carrying nothing but frustration — "I've been scammed." "What happened?" "I don't know." "Who did it?" "I'm not sure." — gives investigators very little to work with.
Someone who calmly produces photographs, screenshots, receipts and a timeline of events makes the situation far easier to understand. Helping the police understand what happened begins before you even walk through the door.
Speaking to the Police
When it's your turn to explain what happened, keep your account simple and factual.
Start at the beginning. Explain events in the order they happened. Avoid exaggeration. Avoid assumptions. If you don't know something, simply say so.
There's a big difference between saying...
"I saw him take my bag."
...and...
"I think he probably planned this with somebody else."
One is something you witnessed. The other is speculation. Keep those two things separate. It makes your statement far stronger.
Making Your Statement
At some point you'll usually be asked to explain exactly what happened. This is often the most important part of reporting a crime.
Take your time. Start at the beginning. Explain events in chronological order. Stick to the facts. If you aren't certain about something, don't guess.
It's perfectly acceptable to say:
"I don't know." "I didn't see that." "I'm not sure."
People often worry that admitting they don't know something makes their case weaker. It doesn't. Guessing does.
Investigators are trying to establish facts. Clear, honest answers are always more valuable than assumptions.
The Importance of Evidence
Police investigate evidence. Not rumours. Not Facebook posts. Not what somebody else's friend claims happened.
If you have evidence, preserve it. That might include:
- Mobile phone photographs.
- CCTV footage.
- Dashcam recordings.
- Hotel key records.
- GPS data.
- Text messages.
- Emails.
- Social media conversations.
- Medical reports.
- Damaged property.
Don't edit photographs. Don't crop screenshots. Don't delete messages because you think they're embarrassing. What seems unimportant today could become highly relevant later.
Keep everything. Let investigators decide what's useful.
Never create evidence.
Never exaggerate events.
Never encourage somebody else to support your version of events if it isn't true.
Making a false report or providing deliberately misleading information can become a criminal matter itself. The truth is always easier to defend than a story that keeps changing.
Language Problems
One of the biggest challenges for foreigners isn't the investigation itself. It's communication.
Even if your English is excellent, that doesn't automatically mean everyone involved will be fluent. Likewise, speaking conversational Thai doesn't necessarily prepare you for legal discussions.
If you don't understand something, ask. If you're unsure what a question means, ask again. If you require an interpreter, say so.
There is absolutely no shame in asking for clarification. Misunderstandings create delays. Clear communication solves problems.
A Practical Note
Foreigners often apologise for asking people to repeat themselves. Don't. This isn't ordering food in a restaurant — it's an official statement that could become part of an investigation.
Take your time, listen carefully and ask questions. Nobody benefits from misunderstandings.
Should You Bring Someone With You?
Sometimes having a trusted friend, family member or Thai speaker with you can make the experience feel less stressful. They may be able to help explain practical matters or provide emotional support.
However, they shouldn't answer questions on your behalf unless they're specifically asked to do so. If you're making a statement, it needs to reflect your own recollection of events, not somebody else's interpretation.
If You've Been Injured
If you've suffered injuries during the incident, seek medical treatment as soon as possible. Your health always comes first.
Medical records may also become important evidence later. Photographs of injuries can be useful, particularly if they're taken as soon as reasonably possible after the incident. If injuries change over the following days, consider keeping a record of that too. Healing bruises and swelling can tell part of the story.
Stolen Property
If property has been stolen, make a list while everything is still fresh in your memory. Include:
- Descriptions.
- Serial numbers.
- Registration numbers.
- Purchase receipts if available.
- Approximate values.
- Distinguishing marks.
The more accurately you can identify stolen items, the greater the chance they'll be recognised if recovered later.
Insurance Claims
Many travel insurance and personal insurance policies require evidence that an incident was reported to the police.
That doesn't necessarily mean compensation will be paid. But failing to report certain incidents could affect your claim.
If you're insured, check your policy conditions as soon as possible and keep copies of any documentation relating to your police report.
Don't Expect Instant Results
Television has created unrealistic expectations.
A crime is reported. An arrest happens the same afternoon. The case is solved by tomorrow.
Real investigations don't usually work like that. Some are resolved quickly. Others take weeks or months. Complex fraud investigations can take considerably longer.
Patience doesn't always feel satisfying. But it's often necessary.
Protect Yourself Today
Report suspected crimes as soon as reasonably possible.
Gather evidence before attending the police station where you can do so safely.
Stick to facts rather than assumptions.
Preserve photographs, messages and documents in their original form.
Ask for clarification whenever you don't understand something.
Keep copies of any reports or paperwork you receive.
If you're unsure about your legal position, seek professional legal advice.
After You've Reported
What Happens After You Report a Crime?
Many people assume that once they've finished speaking to the police, their job is done. In reality, it's often just the beginning.
What happens next depends on the nature of the incident, the available evidence, and whether investigators are able to identify the person responsible.
Some investigations move quickly. Others take considerably longer. That doesn't necessarily mean nothing is happening. Behind the scenes, officers may be:
- Interviewing witnesses.
- Reviewing CCTV footage.
- Obtaining phone or financial records where appropriate.
- Contacting businesses.
- Locating suspects.
- Gathering additional evidence.
Every investigation follows its own path. Trying to compare your case with someone else's experience is rarely helpful.
Keep Copies of Everything
Before leaving the police station, make sure you keep copies of any paperwork you're given.
Store them somewhere safe. Take photographs with your phone. Email copies to yourself. If documents are lost later, having your own copy can save a great deal of time and frustration.
Good organisation becomes increasingly valuable if your case continues for weeks or months.
If You're Contacted Again
It's perfectly normal for investigators to contact you again if they need additional information.
They may ask further questions, request extra documents, clarify something in your original statement, or update you on progress.
If that happens, respond honestly and promptly. If you genuinely don't know the answer to a question, simply say so. Avoid feeling pressured to guess.
A Practical Note
Patience matters when dealing with official processes in Thailand. People often expect daily updates, and when those updates don't arrive they assume nothing is happening. That isn't always the case — some investigations simply take time.
Repeatedly attending the police station demanding immediate answers rarely speeds the process up. Professional, polite communication almost always achieves more than anger.
What If the Person Is Found?
If investigators identify a suspect, the legal process may continue in a number of different ways depending on the circumstances.
Your role as the person reporting the incident may also continue. You could be asked to:
- Confirm evidence.
- Identify property.
- Provide additional information.
- Clarify your original statement.
Continue treating the matter seriously. Even if you believe the case is straightforward, avoid discussing details publicly while investigations remain ongoing.
Social Media Can Cause Problems
It's understandable to feel angry if you've been the victim of a crime. Many people want to warn others. Some decide to publish names. Others post photographs or accusations online.
Be careful.
Publishing allegations before legal matters have been resolved can sometimes create legal difficulties of its own. If you're unsure whether something should be published, discuss it with your lawyer before posting online.
Protecting yourself should always come before winning an argument on Facebook.
Never attempt to take revenge yourself.
Don't threaten people. Don't damage property. Don't encourage friends to confront somebody on your behalf. And don't try to recover money or possessions through intimidation.
If you've reported a matter to the police, allow the legal process to take its course. Taking matters into your own hands can quickly turn a victim into a suspect.
If You Need Legal Advice
Not every crime report requires a lawyer.
But there are situations where professional advice can be extremely valuable. For example:
- Significant financial loss.
- Serious assault.
- Fraud.
- Property disputes with possible criminal elements.
- Cases involving immigration concerns.
- Situations where you've been accused of making a false report.
A lawyer can explain your position, help protect your interests and guide you through any legal proceedings that may follow. Seeking advice early is often easier than trying to fix problems later.
Frequently Asked Questions
Do I need to report every crime to the police?
Not always. Minor disputes or misunderstandings may be better resolved privately or through civil procedures. However, if you've been the victim of theft, assault, fraud, criminal damage, threats or another suspected criminal offence, reporting it as soon as possible is usually the right decision.
What if I don't speak Thai?
Don't let the language barrier stop you from reporting a crime. If you don't understand what's being said, ask for clarification or request an interpreter. It's far better to ask questions than to misunderstand something important.
Should I report a crime even if I don't have much evidence?
Yes. You don't need to solve the crime before reporting it. Explain what happened as clearly as you can and provide whatever information or evidence you have. Investigators can then decide what further enquiries may be appropriate.
Will the police investigate every report?
Every report is assessed on its own facts. Some cases are straightforward and can be dealt with quickly, while others require more extensive investigation. The time taken will depend on the nature of the offence, the evidence available and the complexity of the case.
Can I get a copy of my police report?
In many situations you can obtain documentation confirming that a report has been made. Keep copies of any paperwork you're given, as you may need it for insurance claims, legal proceedings or future reference.
Should I post details of the crime on social media?
Be careful. Publishing accusations, photographs or identifying individuals before matters have been properly investigated can create legal problems of its own. If you're unsure, it's usually better to wait and seek professional advice before posting publicly.
What if I later remember something important?
Contact the investigating officer as soon as reasonably possible. Additional information can often be added to the investigation, particularly if it helps clarify events or provides new evidence.
When should I speak to a lawyer?
Not every police report requires legal representation. However, if you've suffered a significant financial loss, serious injury, become involved in a complex dispute or have concerns about your legal position, obtaining advice from an experienced lawyer can help you understand your rights and the options available.
In Closing
Becoming the victim of a crime is stressful wherever it happens.
When it happens in another country, the uncertainty can feel even greater.
The most important things you can do are report the matter promptly, preserve any evidence, remain patient with the investigation and avoid making emotional decisions that could complicate matters.
Most importantly, remember that you're not expected to understand every aspect of Thai law on your own. If your situation becomes legally complex or you're unsure about your rights, professional advice is often the best investment you can make.
