Everyday Legal Risks in Thailand.

Substances and Everyday Choices

One of the biggest surprises for many people moving to Thailand is discovering that some of the things they took for granted back home can carry very different legal consequences here.

It's rarely the major crimes that catch ordinary people out.

It's the everyday decisions.

• Buying an e-cigarette because you forgot yours.
• Flying a drone over a beach without checking the rules.
• Taking a photograph inside a government building.
• Having one drink too many before deciding to ride your motorbike home.
• Joining an online football betting site.
• Walking out without your passport because you're only popping to the local shop.

Most people aren't trying to break the law.

They simply don't realise the rules are different.

This guide brings together some of the everyday legal issues that regularly affect foreign visitors and residents. Rather than searching seven different articles, you'll find the most common legal tripwires explained in one place.

The aim isn't to frighten you.

It's to help you avoid making simple mistakes that could easily spoil an otherwise enjoyable stay in Thailand.

Drugs. Thailand Is Not as Simple as Social Media Suggests

If you've spent any time on YouTube or TikTok, you could easily come away believing that Thailand has become a country where drug laws no longer matter.

That would be a dangerous misunderstanding.

Thailand has made significant changes to its cannabis laws in recent years, and those rules have continued to evolve. The legal position has changed more than once, and further regulatory changes remain possible.

One thing has never changed.

Thailand continues to take a very serious approach to illegal drugs.

Possession, trafficking, production and importation of controlled substances can result in severe criminal penalties.

Do not assume that because something appears to be openly available, it is automatically legal in every situation.

Cannabis

Cannabis deserves separate mention because it has created more confusion than almost any other subject.

The legal framework has changed several times in recent years, including new restrictions introduced during 2025 and 2026.

Before purchasing, carrying or consuming cannabis products, always check the current legal position.

Do not rely on old YouTube videos, Facebook groups or travel blogs.

The law has changed faster than much of the internet has managed to update.

Importing cannabis products into Thailand or taking them out of the country may involve completely different legal issues from buying products that are lawfully available within Thailand.

Never assume the rules are the same.

Prescription Medication

Many foreigners travel with medication prescribed in their home country.

That is usually perfectly legitimate.

However, some medicines that are commonly prescribed overseas may be controlled substances under Thai law.

Examples can include certain painkillers, ADHD medication, sleeping tablets and anxiety medication.

Before travelling with prescription medicines, check whether additional documentation or import requirements apply.

Keeping medication in its original packaging together with a copy of your prescription can help avoid unnecessary complications.

Vaping. Don't Assume It's Allowed

This catches thousands of visitors by surprise every year.

Many people arrive with electronic cigarettes believing they are treated no differently from the UK or Europe.

Thailand has historically taken a much stricter approach to e-cigarettes and vaping products.

Although enforcement can vary, possession, importation, sale and use of vaping products have all been subject to legal restrictions.

The fact that you see somebody vaping does not necessarily mean it is lawful. Equally, the fact that a market appears to sell vaping products does not make those products legal.

This is one area where "everyone else is doing it" is not a sensible defence.

If you're a smoker planning to visit Thailand, checking the latest position before travelling is far safer than relying on advice posted in online forums.

Gambling. Much Broader Than Many People Expect

Thailand has some of the strictest gambling laws in the region.

Visitors are often surprised to discover that gambling restrictions extend well beyond casinos. Illegal gambling can include:

• Card games played for money.
• Informal betting.
• Sports betting websites.
• Unlicensed lotteries.
• Online gambling services.

Many overseas betting websites remain accessible online. That does not necessarily mean using them is lawful while you are physically in Thailand.

If you enjoy gambling at home, assume nothing. Check the current legal position before taking part in any form of betting.

Alcohol. More Rules Than You Might Expect

Buying alcohol in Thailand is generally straightforward.

However, there are several rules that regularly surprise visitors.

Alcohol sales are restricted during certain hours of the day.

Sales may also be prohibited on certain religious holidays or election days.

Individual venues may also have their own licensing conditions.

Public intoxication is not itself a licence to behave irresponsibly.

Arguments, disorderly behaviour, drink-driving or causing damage to property can quickly transform an enjoyable evening into a criminal matter.

Perhaps the biggest mistake people make is assuming they are "only riding a scooter a short distance".

Drink-driving laws apply regardless of whether you're driving a car or riding a motorcycle.

What Usually Happens in Reality

Most visitors never experience any legal problems.

The people who do are often those who assume that Thailand works exactly like home.

A quick internet search before trying something unfamiliar can prevent a surprising number of problems.

Understanding local laws isn't about limiting your freedom.

It's about protecting your future.

Drones, Photography and Everyday Conduct

Drones. Just Because You Can Fly It Doesn't Mean You Should

Drones have become part of everyday travel.

They're used to capture beaches, islands, temples, mountains and spectacular sunsets. Thailand is one of the most photogenic countries in the world, so it's no surprise that many visitors pack a drone before they even think about a camera.

Unfortunately, flying a drone is not as simple as taking it out of your backpack.

Depending on the type of drone, its weight, whether it has a camera, and how it will be used, registration requirements and operating rules may apply. In many cases, operators need to comply with requirements administered by the Civil Aviation Authority of Thailand (CAAT), and some drones also require registration with the National Broadcasting and Telecommunications Commission (NBTC).

Even if your drone is correctly registered, there are still places where flying is restricted or prohibited. These commonly include:

• Airports and flight paths.
• Military installations.
• Government buildings.
• Some national parks.
• Certain historical and cultural sites.
• Areas where temporary flight restrictions are in force.

Many hotels, private developments and event organisers also prohibit drones on private property without permission.

The safest approach is simple.

Plan your flight before you arrive, understand where you intend to fly, and always check whether local restrictions apply.

Photography. Not Every Photograph Is Appropriate

Thailand is an incredibly welcoming country for photographers.

Most people are happy to smile for a photograph if approached politely.

However, good manners and common sense are just as important as the law.

Think carefully before photographing:

• Police officers carrying out their duties.
• Military personnel.
• Security checkpoints.
• Court buildings.
• Government offices.
• Immigration facilities.
• Private homes.
• Children without parental consent.

Inside temples, museums and places of worship, photography rules may differ from one location to another. Some areas permit photography. Others prohibit flash photography. Some prohibit all photography entirely.

Always follow signs and respect requests made by staff.

Remember that legal permission and social acceptance are not always the same thing.

You may technically be allowed to take a photograph, but still cause offence if you ignore local customs or personal privacy.

Carrying Identification

A question that comes up regularly is:

"Do I really need to carry my passport everywhere?"

The practical answer is usually no.

The legal answer is slightly more nuanced.

Foreign nationals should be able to identify themselves if requested by the appropriate authorities.

Walking around with your original passport every day isn't always practical, particularly if you're spending time at the beach or taking part in outdoor activities.

Many long-term residents carry a high-quality photocopy or secure digital copy for everyday purposes while keeping the original document somewhere safe.

However, there may be situations where the original passport or another official immigration document is required.

If a police officer or immigration official asks you to identify yourself, remain calm, polite and cooperative. Arguments on the street rarely improve the situation.

Recording Police Officers

People occasionally ask whether they can record an interaction with the police.

There is no simple "yes" or "no" answer.

The circumstances matter.

A calm interaction where you discreetly preserve evidence is very different from aggressively pushing a camera into someone's face while refusing lawful instructions.

If you are involved in an incident, remain respectful and avoid escalating the situation.

If you believe something improper has occurred, there are more effective ways to deal with it than turning a roadside conversation into a confrontation.

Laser Pointers, Fireworks and Other Restricted Items

Visitors sometimes assume that if an item can be bought in a market, it must be legal to use anywhere.

That is not necessarily true.

The use of fireworks, powerful laser devices and certain other items may be controlled by local laws or require permission.

Causing danger to other people or damaging property can create legal consequences regardless of how easily the item was purchased.

Always think beyond the purchase itself.

Ask where, when and how something can lawfully be used.

Respecting Official Instructions

Most legal problems involving ordinary visitors do not begin with the original issue.

They begin with refusing a reasonable instruction.

Whether you're dealing with security staff, police officers, immigration officials or local authorities, remaining polite almost always leads to a better outcome than becoming argumentative.

If you believe a decision is wrong, there are usually proper procedures for challenging it afterwards.

Trying to win the argument on the pavement rarely achieves anything useful.

The Habit That Keeps People Out of Trouble

Thousands of foreigners live in Thailand for decades without ever experiencing a legal problem.

They don't achieve that because they know every law by heart.

They achieve it because they adopt a simple habit.

If they're unsure, they check first.

They don't assume.

They don't rely on rumours.

They don't believe everything they see on YouTube.

That mindset alone prevents countless unnecessary problems.

Simple Habits That Will Keep You Out of Trouble

If you only remember a few things from this guide, make them these:

• Never assume Thai law is the same as the law in your home country.
• Don't rely on social media for legal advice.
• Respect police officers and public officials, even if you disagree with them.
• Carry some form of identification and know where your original passport is.
• Think before flying a drone or taking photographs in sensitive locations.
• Check the latest rules before buying cannabis, carrying prescription medicines or using vaping products.
• If something feels legally uncertain, spend five minutes checking before acting.

Those five minutes could save you weeks of stress later.

When Professional Advice Becomes Sensible

Most people will never need legal advice for the subjects covered in this guide. However, if you've already been accused of committing an offence, had property seized, received official paperwork or become involved in a police investigation, obtaining legal advice at an early stage can help you understand your rights and responsibilities before the situation becomes more complicated.
