Common Property Scams in Thailand

How Property Scams Actually Work

You finally find the perfect property.

The photographs look exactly like what you've been searching for. The location is ideal. The price seems fair. The owner sounds friendly. Everything feels genuine.

Then comes the sentence that should immediately make you slow down.

"We just need a deposit today to secure it."

Property scams in Thailand rarely begin with obvious fraud.

Most begin with urgency.

• Someone tells you there are three other interested buyers.
• Another tenant is apparently arriving this afternoon.
• The price is only available until tomorrow.
• The developer says there are just two units left.
• A contractor needs the money immediately to buy materials.

Pressure is one of the oldest tricks in property fraud.

The more somebody wants you to make a quick decision, the more important it becomes to slow the process down.

Thailand has an active and professional property market, and the overwhelming majority of agents, developers, landlords and builders operate honestly. Unfortunately, like every country, there are also individuals who exploit unfamiliarity with the legal system, language barriers or a buyer's excitement.

This guide explains the most common property scams affecting foreigners, how they usually work, what warning signs to look for and, most importantly, how to avoid becoming a victim.

Understanding the Difference Between a Scam and a Dispute

Not every disagreement is fraud.

Sometimes a builder genuinely falls behind schedule. Sometimes a landlord believes deductions from a deposit are justified. Sometimes a developer experiences delays beyond their control. Those situations may become contractual disputes.

A scam is different.

Generally speaking, someone is deliberately misleading another person to obtain money, property or another financial advantage.

Recognising that distinction matters because the way you deal with a scam is often very different from the way you resolve an ordinary disagreement.

The Biggest Mistake People Make

People often spend weeks researching visas. Months comparing areas. Hours reading reviews.

Yet they'll transfer hundreds of thousands of Baht after a single video call because someone appears trustworthy.

Never confuse confidence with credibility.

Always verify independently.

The safest property buyers are not suspicious of everyone. They're simply careful with everyone.

Scam 1. The Fake Rental Listing

This is one of the most common online scams.

A fraudster copies photographs from a genuine property listing. They advertise the apartment on Facebook Marketplace, social media groups or classified websites. The price is noticeably cheaper than similar properties.

When you enquire, you're told the owner is overseas or currently travelling. Viewing isn't possible today. However, the property can be reserved immediately with a refundable deposit.

The moment the money is transferred, communication stops.

Sometimes the apartment exists. Sometimes it never belonged to the person advertising it. Sometimes it isn't even available for rent.

How to Protect Yourself

Never pay a reservation deposit before confirming:

• The property exists.
• The person has authority to rent it.
• You have viewed it yourself or through someone you completely trust.
• A written agreement has been prepared.

If you're overseas, consider asking an independent person to inspect the property before transferring any money.

Scam 2. The Disappearing Deposit

This usually affects renters rather than buyers.

A landlord or agent asks for one month's rent and two months' deposit. Everything appears normal.

However, after payment: the viewing is repeatedly postponed, the keys never appear, the owner suddenly becomes unavailable, or the advertiser simply disappears.

Always ask for written receipts.

Make payments through traceable banking channels rather than cash whenever possible.

Ensure you know exactly who is receiving your money.

Scam 3. The Fake Owner

Sometimes the person showing you a property isn't actually entitled to rent or sell it. They may be:

• A former tenant.
• Someone with temporary access.
• Someone pretending to represent the owner.
• Someone using forged documentation.

Before transferring significant sums, ask reasonable questions. Who owns the property? Can ownership be demonstrated? Does the individual have written authority to act on the owner's behalf?

Legitimate sellers and agents should understand why these questions matter.

Scam 4. The Pressure Sale

"We have another buyer." "The promotion ends today." "If you don't decide now, someone else will."

These phrases appear in property markets around the world.

Sometimes they're completely genuine. Sometimes they're designed purely to prevent you carrying out proper checks.

Buying property should never feel like bidding during an auction unless it actually is one.

If someone discourages you from obtaining independent legal advice or reviewing documents carefully, consider that a warning sign.

Scam 5. Contractors Asking for Large Upfront Payments

Building projects often require deposits. Materials need purchasing. Workers need paying. That is perfectly normal.

Problems arise when:

• Large sums are requested before work begins.
• Progress payments bear no relationship to completed work.
• The contractor repeatedly asks for advances.
• Receipts become vague.
• Completion dates continually move.

A sensible building contract should divide payments into clearly defined stages linked to completed work rather than promises about future progress.

What Usually Happens in Reality

Many unfinished building projects do not begin as scams.

Cash flow becomes difficult. Workers leave. Material prices increase. The contractor starts another project to fund the previous one. Eventually everything slows down.

Whether this amounts to fraud or simply poor business depends entirely on the circumstances.

Either way, releasing money faster than work is completed significantly increases your financial risk.

Scam 6. The Renovation Quote That Keeps Growing

You receive an attractive quotation. Work begins.

A week later you're told unexpected problems have been discovered. Then additional work becomes essential. Then more materials are required. Then prices have increased.

Some variation is perfectly normal during renovation projects. However, substantial changes should always be agreed before the work proceeds.

Ask for revised written quotations rather than relying on verbal estimates. Never assume you'll remember exactly what was discussed months later.

Scam 7. Buying Property Through Informal Agreements

Occasionally people are encouraged to bypass formal documentation because "it saves time," "it saves tax," or "we've always done it this way."

Shortcuts in property transactions often become expensive later.

Property ownership, leases and contractual rights should always be properly documented in accordance with Thai law.

If someone appears reluctant to produce formal paperwork, ask yourself why.

Recognising the Warning Signs

Scam 8. "You Can Own the Land, Everyone Does It"

Few subjects create more confusion than land ownership in Thailand.

From time to time, foreigners are told that there is an easy way around the law. The conversation usually sounds reassuring:

• “Lots of foreigners do it.”
• “The authorities never check.”
• “My lawyer has a special way.”
• “My company can hold the land for you.”
• “If you use Thai shareholders, it's perfectly legal.”

These conversations should immediately make you cautious.

Under Thai law, foreign ownership of land is heavily restricted. While there are lawful ways for foreigners to use or control property through leases, condominium ownership (subject to the legal requirements), investment schemes and certain other arrangements, any structure created purely to disguise foreign ownership may carry significant legal risk.

One of the most widely discussed examples is the use of nominee shareholders. A nominee arrangement generally refers to Thai individuals holding shares in a company on behalf of a foreigner without having a genuine ownership interest or business purpose.

Thai authorities have repeatedly stated that unlawful nominee structures may be investigated and enforced against.

If anyone tells you that a nominee company is "completely safe" or "guaranteed", treat that claim with extreme caution.

This is one area where independent legal advice before signing anything is money extremely well spent.

Scam 9. The Fake Lawyer or Unqualified Adviser

Property purchases often involve large sums of money.

Unfortunately, some people present themselves as legal experts without being qualified to provide legal advice. They may call themselves:

• Property consultants
• Legal advisers
• Investment specialists
• Documentation experts

Some are highly experienced professionals working within their area of expertise. Others are not.

If someone claims to be acting as your lawyer, make sure they genuinely are. Ask questions. Understand who you are paying. Know exactly what service is being provided.

Professional advice should never depend entirely upon someone's Facebook page or YouTube channel.

Scam 10. The Guaranteed Investment

"You'll earn 12% every year." "We guarantee rental income." "This area is about to double in value." "No risk."

Whenever somebody guarantees investment returns, slow down.

Property values move. Rental markets change. Tourism fluctuates. Economic conditions change.

No honest adviser can guarantee future investment performance.

That doesn't mean every investment opportunity is poor. It simply means guarantees should be treated with healthy scepticism.

Scam 11. Off-Plan Promises That Never Appear in the Contract

Sales presentations can be persuasive. You'll be shown impressive computer-generated images:

• Luxury facilities.
• Future shopping centres.
• International schools.
• New transport links.
• Future marinas.
• Beautiful landscaped gardens.

The important question is simple: which of those promises actually appears in the contract?

Marketing material is not always the same as contractual obligations.

Read the purchase agreement carefully. If a promised feature is important to your decision, ask whether it forms part of the legal agreement rather than the sales presentation.

Scam 12. The Fake Title Deed

This is thankfully uncommon but potentially devastating.

Never rely solely on photocopies or verbal assurances regarding land ownership. Official title documents should always be verified as part of proper legal due diligence.

Independent legal advisers routinely carry out checks relating to title, registered interests, mortgages, restrictions and ownership before significant transactions complete.

Skipping those checks to save money can become one of the most expensive decisions a buyer ever makes.

Scam 13. Social Media Property "Experts"

Social media has made it easier than ever to find property.

It has also made it easier for anyone to present themselves as an expert.

Large follower numbers do not prove professional qualifications. Neither do expensive cars, luxury lifestyles or confident videos.

Ask yourself:

• What experience do they actually have?
• Who pays them?
• Do they receive commission?
• Are they recommending what's best for you or what pays them the highest fee?

Always separate marketing from independent advice.

The Due Diligence Checklist

Before paying significant money for any property transaction, slow the process down and work through a simple checklist.

• Confirm who owns the property.
• Read every contract carefully.
• Understand exactly what you're buying or renting.
• Check all costs.
• Understand taxes and fees.
• Keep written records.
• Avoid unnecessary cash payments.
• Never sign documents you don't understand.
• Take independent advice where the financial commitment is significant.

Good due diligence rarely feels exciting. That's because it's designed to prevent expensive surprises later.

What Should You Do If You Think You've Been Scammed?

Act quickly. Gather every document you have. This includes:

• Contracts
• Receipts
• Bank transfer confirmations
• Emails
• Text messages
• Screenshots
• Property advertisements
• Photographs
• Voice messages where relevant

Avoid deleting conversations, even if they seem embarrassing. Sometimes a single message becomes an important piece of evidence.

If criminal fraud is suspected, reporting the matter promptly may help preserve evidence and improve the chances of investigating what happened.

Where the dispute is contractual rather than criminal, obtaining early legal advice can help clarify your available options.

The Reality Behind Most Transactions

The internet can sometimes make Thailand appear full of scams.

That isn't the reality.

Millions of successful property transactions take place every year. Most landlords are honest. Most developers complete their projects. Most estate agents want satisfied clients.

The people who avoid becoming victims are rarely experts in Thai law. They simply refuse to rush. They ask questions. They verify information independently.

And they never allow excitement to replace careful judgement.

When Professional Advice Becomes Sensible

Buying or selling property is often one of the largest financial decisions you'll ever make. Where substantial money is involved, ownership structures are complex, or documents are unclear, obtaining independent legal advice before signing anything is usually far less expensive than trying to resolve problems afterwards.
