Do we have to be legally married to apply based on our relationship?
Not necessarily. Immigration New Zealand recognises qualifying partnerships that can include legal marriage, civil union and de facto relationships. What matters is that the relationship meets the requirements of the particular partnership pathway, including the genuine and stable relationship and living-together requirements that apply.
Immigration New Zealand specifically looks for evidence that partners are living together in a genuine and stable relationship. Depending on circumstances, evidence may include shared address evidence, tenancy or housing records, household correspondence, joint finances, shared bills, official correspondence, travel or history showing periods together, and other genuine cohabitation evidence.
Does Immigration New Zealand require couples to live together?
Partnership-based applications require evidence that the couple are living together in a genuine and stable relationship. The precise requirements, including how long the couple must have lived together for some pathways, depend on the particular visa or residence category.
There are different partnership routes. Depending on circumstances, these can include partnership-based visitor status, partnership-based work status and partnership-based residence. The partner's own New Zealand status matters in determining which route is relevant. For example, the Partner of a New Zealander Resident Visa currently requires the applicant to have been living with their qualifying New Zealand citizen or resident partner in a genuine and stable relationship for at least 12 months when applying — a requirement specific to that residence category rather than a rule applying to every partnership pathway.
Is there one New Zealand Partner Visa that applies to every couple?
No. New Zealand has different partnership-based visa and residence pathways. The relevant route depends on the couple's circumstances, the supporting partner's status and whether the proposed stay is temporary or permanent.
Depending on the case, relevant documents may involve passports and identity documents, marriage certificate where applicable, divorce documentation where relevant, name-change documents, Thai civil records, relationship evidence, cohabitation evidence, evidence relating to the supporting partner, and other application-specific documents. Translations may be required where applicable.
The supporting partner's circumstances can be important. Depending on the route, this may involve evidence relating to identity, citizenship or immigration status, residence circumstances, relationship with the applicant, living arrangements, support for the application, and other pathway-specific evidence.
Does my partner's New Zealand immigration status affect which route applies?
