Where there’s a will there’s a way.

This saying is very true when it comes to making a will in Thailand.

People underestimate the importance of their will and that of their Thai spouse.

To have good Estate Planning is to ensure you and your loved ones are taken care of when you or your spouse dies.

If you are married to a Thai citizen and have property together it is very important to have a carefully worded and carefully executed will to protect your investment and property in the event that they pass before you.

Are you aware of the restrictions to foreigners and the red tape surrounding property law in Thailand?

A Thai Will for properties in Thailand or abroad

A Thai Will and Estate planning is certainly not something people want to think about but it is important to have good estate planning to ensure you and your loved ones are taken care of if your partner or you pass away. If there is no last will and testament, the intestate's assets must be distributed in accordance with the classes of relations as stipulated in the CCC Section 1629 which are, in order of priority:

Children

Parents;

Brothers and sisters of full blood;

Brothers and sisters of half-blood;

Grandfathers and grandmothers;

Uncles and aunts.

Before the distribution of the estate to the relatives, half of the estate will belong to the spouse, The other half will be equally distributed accordingly. If there are no living relations and no Thai will, the estate will devolve on to the State. As such, we do strongly recommend making a Thai Will to cover all of your properties and assets in Thailand.

Importance of Thai Will

There are a lot of obstacles and potential things that can happen which can affect your right to property if you are not aware of your legal rights in Thailand and you have not prepared for all eventualities.

 The entire process can become quite a tangled web and, very costly if certain precautions are not taken early on. One of the major concerns in any property acquisition is the minimization of risk and the security of your investment. This is even more important when you purchase properties outside of your own jurisdiction.

 Lawyers for Expats Thailand can eliminate the risks and give you peace of mind.

We provide services for creating a safe and legal Will for you and your spouse. The document will detail your assets in Thailand, such as property, bank accounts, vehicles, and personal items. Typically, upon the death of a foreigner in Thailand, the government officer will ask the family for a copy of a Will or they will seek the deceased person's lawyer for this document.  We recommend a separate Will for your spouse and for your foreign assets.
