Thailand Has Entered a New Chapter
Thailand has long been recognised as one of Asia's most welcoming countries for LGBTQ+ people.
Following changes in Thai law, same-sex couples can now legally marry in Thailand, giving couples many of the same legal rights and responsibilities as opposite-sex married couples.
For many people, this represents a significant and positive step forward.
If you're a foreign national planning to marry your Thai partner, or you're already building a life together in Thailand, it's important to understand how these changes may affect you.
Much of the Law Is Now the Same
From a practical point of view, many of the legal issues discussed throughout Lawyers for Expats Thailand's Marriage to a Thai National guide now apply equally to same-sex couples. These include:
- Registering a legal marriage.
- Immigration options based on marriage.
- Financial planning.
- Wills and estate planning.
- Property ownership.
- Inheritance.
- Family finances.
- Long-term planning.
Rather than creating two completely separate guides, Lawyers for Expats Thailand treats these subjects in the same way because, legally, many of the same principles now apply.
Marriage Is Still Different From a Ceremony
Just like opposite-sex couples, a celebration or commitment ceremony alone does not create a legal marriage.
To receive the legal rights and protections available under Thai law, the marriage must be properly registered with the relevant authorities.
Immigration
Marriage may provide access to immigration pathways that are available to married couples.
However, marriage itself does not automatically grant:
- Thai citizenship.
- Permanent residence.
- The right to work.
- Unlimited permission to remain in Thailand.
Immigration rules continue to apply, regardless of the gender of either spouse.
Property, Wills and Inheritance
Building a life together often involves buying property, saving money and planning for the future.
Whether you're in a same-sex or opposite-sex marriage, sensible planning remains exactly the same. You should consider:
- Making a will.
- Reviewing beneficiaries.
- Keeping important documents together.
- Planning for emergencies.
- Understanding how your assets are owned.
- Seeking professional advice for more complex estates.
Good planning protects the people you love.
Cohabitation Without Marriage
Many couples choose to live together without getting married.
This may suit their personal circumstances, but it's important to understand that living together does not automatically provide the same legal rights as marriage.
If you're sharing finances, buying property together or making long-term plans, it's sensible to understand how those arrangements are documented and protected.
Professional legal advice can be particularly valuable where significant assets are involved.
A Personal Note
People come to Thailand from every background imaginable.
Different nationalities. Different cultures. Different religions. Different relationships.
Our role isn't to tell people how they should live their lives.
It's to help them understand how Thai law works, so they can make informed decisions and protect themselves legally.
If you're building a future with someone you love, good planning, honest communication and understanding the law will always be more important than assumptions.

Marriage doesn't automatically grant Thai citizenship, permanent residence, the right to work, or unlimited permission to remain. Immigration rules apply the same way regardless of the gender of either spouse.
Wills, beneficiaries, property ownership and estate planning all deserve the same attention as in any marriage. Good planning protects the people you love.
Living together without marrying doesn't provide the same legal protections as marriage. Get advice early if you're sharing finances or buying property together unmarried.
