How We Help
Updating Thai marriage records after a foreign divorce, Power of Attorney registration for absent spouses, and contested Family Court proceedings — handled by specialist cross-border divorce lawyers.

How We Help
A foreign divorce does not automatically update Thai marriage records. Four steps from instruction to a confirmed civil status update.
The correct procedure depends on the country where the divorce was obtained and how it was granted. We know which countries' divorces the District Office will accept directly and which require a separate court confirmation process in Thailand — and we tell you at the outset, not midway through.
The foreign divorce document must be authenticated and certified in the issuing country before it can be presented in Thailand. Getting the apostille chain wrong or using a non-certified translation means the entire process restarts. We manage this from the Thai end, coordinating with overseas lawyers and notaries where needed.
Where the District Office route applies, we attend and manage registration — with the absent spouse represented by a correctly drafted Power of Attorney if they cannot travel. Where the court route is required, we file the application, manage service abroad and represent you throughout.
Once the Thai civil status record is updated, we confirm completion and advise on consequential matters — remarriage in Thailand, property transactions that were pending on marital status, estate planning updates or immigration matters involving a new partner.
My foreign divorce was over five years ago and my Thai records were never updated. Can you still help?
Yes. The recognition process is available regardless of how long ago the foreign divorce was granted. We locate and authenticate the original divorce document — or coordinate obtaining a certified copy from the issuing court abroad — and manage the full Thai recognition process from there. The delay does not make the process more difficult, but the unresolved record will have caused practical complications in the interim.
What We Do For Our Clients
Cross-border divorce involves the Thai legal process and at least one foreign legal system. Here is the actual scope of what our team handles.
We manage the full recognition process for divorces obtained abroad — authentication coordination in the client's home country, certified Thai translation, and District Office filing or court application as appropriate. The Thai civil registration system does not update automatically on a foreign divorce: this process is required.
What are the practical consequences of leaving a Thai marriage unresolved?
A client who remains recorded as married in Thailand cannot legally remarry here. Thai property transactions may be complicated or blocked. Estate planning involving Thai assets becomes confused. Immigration status for a new partner can be affected. We see these problems at every stage — some clients come immediately after a foreign divorce, others years later when an unresolved record causes a specific problem.
Where both parties agree to divorce but one spouse cannot travel to Thailand, we draft a Power of Attorney authorising a representative in Thailand to sign the registration at the District Office on their behalf. We advise on the notarisation and apostille steps required in the absent spouse's country and coordinate the authentication from the Thai end.
We both agree to the divorce. My spouse is in Germany and cannot travel to Thailand.
Your spouse grants a Power of Attorney to a representative in Thailand — typically a lawyer — authorising them to sign the divorce registration at the District Office on their behalf. We draft the POA, advise on the notarisation and apostille steps required in Germany, and then manage the District Office registration when the authenticated POA arrives in Thailand. Both parties do not need to be physically present.
Where a spouse will not engage or cannot be located, the matter proceeds through the Thai Family Court. We file the application, manage service of court documents on a defendant abroad through international legal assistance channels, and represent you throughout the proceedings.
My ex-spouse is abroad and is refusing to engage. Can I still get divorced in Thailand?
Yes. Where a spouse is uncooperative, the matter proceeds through the Thai Family Court. We file the application, manage service of proceedings on the defendant abroad through international legal assistance channels, and represent you throughout. The court can grant a divorce on specific statutory grounds without the defendant's consent. Where a spouse genuinely cannot be located, we advise on whether service by publication is available in your circumstances.
Cross-border divorce matters require coordination between the Thai legal process and the authentication or legal procedures in another country. We manage that coordination from the Thai end and liaise with correspondent lawyers and notaries abroad to ensure the documentation meets Thai standards.
After recognition or registration, we confirm the updated civil status record and advise on any downstream steps — whether that is remarriage in Thailand, a property transaction that was blocked on marital status, or estate planning adjustments.
I need to sell a Thai property, but I am still showing as married in Thailand. How quickly can this be resolved?
The urgency of a pending property transaction affects how we sequence and prioritise the process. The District Office route — where it applies — is typically faster than court proceedings. We assess which route is correct for your specific divorce document and country, then manage the authentication, translation and District Office steps as efficiently as possible. We advise on a realistic timeline at the outset so you can plan the transaction accordingly.
Where a divorce involves Thai property, marital asset division or custody of children in Thailand, we advise on those matters alongside the divorce proceedings — ensuring the approach to recognition or court proceedings is coordinated with any ancillary orders sought.
Our Commitment To You
District Office or Family Court — the wrong choice wastes months. We assess the divorce document, the issuing country and the specific circumstances before advising on the correct route. You are not told the wrong process is available and then corrected when the District Office rejects the application.
An incorrect apostille chain or non-certified translation means the process restarts from scratch. We manage the authentication sequence correctly — including what is required in the foreign country — before anything is presented to the Thai authorities.
Do I need to travel to Thailand to complete the recognition or registration process?
Not necessarily. For uncontested matters handled at the District Office, the absent spouse can authorise a representative via a correctly drafted and authenticated Power of Attorney to sign the registration in Thailand on their behalf. We draft the POA, advise on the authentication steps required in your country, and attend the District Office with the representative. For contested court matters, attendance at certain hearings may be required — we advise on this at the outset.
Clients do not need to manage their overseas lawyers and notaries at the same time as their Thai process. We coordinate from the Thai end, advise on what is required in the other country, and ensure the two processes are aligned.
Where a property transaction or remarriage is time-sensitive, we advise on a realistic timeline at the outset so you can plan accordingly. We do not give optimistic estimates and we do not create urgency pressure that pushes you into the wrong process.
